Olivia Pratt-Korbel's killer Thomas Cashman has had his latest bid to challenge his sentence rejected.<\/p>\n
Cashman, 35, was found guilty of murdering the schoolgirl and handed a life sentence with a minimum term of 42 years after a trial at Manchester Crown Court. Olivia, nine, was killed on August 22 last year when Cashman fired a bullet through the front door of her family home in Dovecot.<\/p>\n
The killer previously applied to challenge his minimum jail term, but this was rejected without a hearing earlier this year. Today's hearing saw Cashman's legal team lodge a fresh application heard at the Court of Appeal in London this morning (Wednesday, November 15) before appeal judges Dame Victoria Sharp, Mrs Justice McGowan and Mr Justice Chamberlain.<\/p>\n

His barrister, John Cooper, KC said before the decision was reached: "This is a renewed application on behalf of the applicant Thomas Cashman following a refusal by a single judge. I hope the court has had our most recent sentencing note."<\/p>\n
Mr Cooper said Cashman's case had rested too heavily on the idea he had no remorse for the killing. He told the court: "It was wrong or at very least excessive to suggest the remorse expressed at the death of this child was non-existent. There was no intention to kill, the gun was not even fired in the direction of the child intentionally.<\/p>\n

"It would have been a totally different situation if the gun had been fired at the child, and no remorse had been expressed." Despite this, the appeal judges chose not to reconsider Cashman's minimum term.<\/p>\n
Dame Sharp said: \u201cThe sentence imposed by the judge was a long one, it means the applicant will be well into his seventies before being considered for his release. The length of the sentence reflects the terribleness of his crimes rather than any error on the part of the judge. There were no mitigating factors, there was no remorse. Permission to appeal is refused\u201d.<\/p>\n
Cashman did not appear at the hearing but a court official and a lawyer representing him said he planned to appeal again following today's rejection. They said the application had yet to be considered by a judge and no appeal hearing date had been fixed.<\/p>\n
Olivia was fatally shot as Cashman chased and aimed at convicted drug dealer Joseph Nee, who tried to run into the girl\u2019s home to escape his aggressor.<\/p>\n
The killer also hit Olivia\u2019s mother Cheryl Korbel in the wrist as she tried to keep the door shut on Nee. The same bullet then hit and killed her daughter.<\/p>\n
